These terms and conditions of sale, hereinafter the "T&Cs", govern sales of products on the website az-flag.com between AZ FLAG and its customers.
They apply to any order placed on the site, whether the customer is a consumer or a business.
Some provisions apply only to consumers within the meaning of the French Consumer Code. Business customers are subject to specific provisions concerning them.
Placing any order on the site implies the full and complete acceptance of these T&Cs by the customer.
Additional information regarding delivery, returns and refunds may be specified in the help pages of the site. In the event of contradiction, these T&Cs prevail.

In these T&Cs, "AZ FLAG" refers to the company AZ FLAG, operator of the site and seller of products offered on az-flag.com.
AZ FLAG offers for sale flags, banners, accessories, decoration products, customisable items and, more generally, the products presented on the site.
The essential characteristics of the products are indicated on product pages. Photographs, visuals and illustrations are presented for information purposes. Slight differences may exist between the visuals and the products delivered, particularly due to screen settings, materials, manufacturing processes, or production variations.
AZ FLAG reserves the right to modify the assortment of products offered for sale at any time.
Some products may be personalised at the customer's request, including by adding texts, logos, images, graphic files, colours, dimensions, or other particular specifications.
The customer is solely responsible for the elements transmitted to AZ FLAG for the production of a personalised product. The customer warrants that they hold all rights, authorisations and licences necessary on the texts, images, logos, trademarks, files, designs, models or other elements transmitted.
The customer is invited to carefully verify the files, texts, visuals, dimensions, colours and instructions transmitted before validating the order.
AZ FLAG cannot be held liable for any error resulting from a file provided by the customer, particularly in the case of poor quality file, incorrect dimensions, insufficient resolution, typographical error, colour error, lack of bleed, wrong format or technical non-compliance.
When the site does not provide a proof, mock-up or specific preview, validation of the order by the customer constitutes validation of the elements transmitted, of the characteristics chosen and of the personalisation requested.
When AZ FLAG submits a mock-up, preview or proof to the customer, manufacturing may be launched after validation by the customer. Validation of the proof, mock-up or preview constitutes definitive agreement by the customer on the validated elements, subject to the applicable legal warranties.
Minor rendering differences, particularly in colour, size, positioning, cut, material or finish, that may result from technical constraints of manufacturing, printing, screen display or textile support, do not constitute a conformity defect when they remain reasonable and do not affect the normal use of the product.
Personalised products or products manufactured according to the customer's specifications do not benefit from the legal right of withdrawal, in accordance with applicable provisions of the Consumer Code.
Product prices are indicated on the site in the currency applicable to the version of the site consulted.
Unless otherwise stated, prices are indicated inclusive of all taxes for consumers located in the European Union, excluding shipping costs, customs duties, import taxes or other fees applicable depending on the country of delivery.
AZ FLAG reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation, subject to manifest error.
In case of manifest pricing error, AZ FLAG reserves the right to cancel the order and refund the customer.
Product offers are valid subject to stock availability.
If a product becomes unavailable after order validation, AZ FLAG will inform the customer as soon as possible and propose, depending on the case, an equivalent product, an additional delay or a refund.
Promotional codes, discounts and commercial offers are valid only for the duration and under the conditions indicated at the time of their issuance.
Unless otherwise stated, they are neither combinable, exchangeable nor refundable.
AZ FLAG reserves the right to refuse or cancel the use of a promotional code in the event of manifest error, fraudulent or abusive use, or use contrary to the conditions of the offer.
The customer places orders directly on the site.
Before final validation, the customer can verify the details of the order, the products selected, the total price, the delivery address, the billing address and the chosen delivery method.
The order becomes final after validation by the customer and effective payment, except for special conditions expressly accepted by AZ FLAG.
AZ FLAG reserves the right to refuse or cancel any order in case of existing dispute with the customer, suspicion of fraud, manifest error, product unavailability or payment difficulty.
Payment is made using the means of payment offered on the site at the time of the order.
The accepted means of payment are indicated on the site at the time of the order. They may include, depending on the country and the available options, payment by credit card, PayPal, bank transfer or any other method offered on the site.
The order is considered definitively validated after payment confirmation.
AZ FLAG does not store complete credit card details on its servers. Payments are processed by secure payment providers.
In case of payment refusal, payment incident or suspicion of fraud, AZ FLAG reserves the right to suspend or cancel the order.
The products remain the property of AZ FLAG until full payment of the price by the customer.
For consumers, the transfer of risk occurs when the customer, or a third party designated by the customer other than the carrier proposed by AZ FLAG, takes physical possession of the product.
For business customers, unless otherwise agreed in writing, the risk is transferred to the customer upon handover of the products to the carrier.
For business customers, unless particular conditions agreed in writing, invoices are payable in cash at the time of order.
When a payment deadline is granted in writing, it cannot exceed the deadlines provided in Article L.441-10 of the French Commercial Code.
Any late payment will result in late payment penalties calculated according to the conditions indicated on the invoice or, failing that, in accordance with the applicable legal provisions, as well as the fixed recovery indemnity of €40 provided for in the Commercial Code.
AZ FLAG also reserves the right to suspend current or future orders until full payment of sums due.
Products are delivered to the address indicated by the customer at the time of the order.
The applicable delivery costs and timeframes are indicated before order validation. Timeframes may vary according to the destination, the carrier, product availability, periods of high activity, or any customs formalities.
The customer is responsible for the accuracy of the delivery information provided. AZ FLAG cannot be held liable in case of delay, loss or impossibility of delivery resulting from an incomplete, incorrect or inaccessible address.
In case of significant delay or delivery difficulty, the customer can contact customer service for information about the order tracking.
Unless expressly agreed between the parties or a specific timeframe is indicated before order validation, AZ FLAG undertakes to deliver products ordered by a consumer customer within a maximum period of thirty (30) days following the conclusion of the contract.
If this period is exceeded, the consumer may request AZ FLAG to make the delivery within a reasonable additional period. Failing delivery within this additional period, the consumer may terminate the contract and obtain a refund of the amounts paid, under the conditions provided by the French Consumer Code.
The customer is invited to verify the condition of the products upon receipt.
In case of damaged, opened, incomplete parcel or one showing an apparent anomaly, the customer is invited to formulate precise reservations with the carrier and contact AZ FLAG as soon as possible, with any useful evidence, particularly photographs of the parcel and the products concerned.
This verification does not deprive the consumer of their rights under the legal warranties.
AZ FLAG offers its consumer customers a return policy of 30 days from receipt of the product.
To benefit from this return, the product must be returned complete, unused, undamaged and, as far as possible, in its original packaging.
The customer must inform AZ FLAG of their wish to return the product before the expiry of the 30-day period.
Except for errors attributable to AZ FLAG or defective products, return costs are at the customer's expense.
The refund occurs after receipt and verification of the returned products, using the payment method used at the time of the order.
The 30-day return policy does not apply to personalised products or products manufactured according to the customer's specifications.
In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumers have a legal period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify a reason.
The 30-day return policy is a commercial guarantee offered by AZ FLAG, distinct from the legal right of withdrawal. It applies under the conditions and limits set out in Article 14 of these T&Cs, without depriving the consumer of the legal right of withdrawal.
To exercise their right of withdrawal, the customer can use the form in the appendix of these T&Cs or send AZ FLAG an unambiguous declaration expressing their wish to withdraw.
Except for errors attributable to AZ FLAG or defective products, return costs are at the customer's expense.
AZ FLAG may defer reimbursement until receipt of the returned products or until the customer provides proof of shipment, whichever is the earlier.
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply notably to products manufactured according to the consumer's specifications or clearly personalised.
This applies in particular to products personalised with text, logo, image, file, colour, dimension, marking, printing or any other particular specification requested by the customer.
The right of withdrawal may also be excluded in the other cases provided for by law.
In case of withdrawal or accepted return, AZ FLAG refunds amounts due to the customer using the payment method used at the time of the order, unless otherwise agreed with the customer.
Returned products that are incomplete, used, dirty, damaged or unfit for resale may be subject to refusal of refund or a reduction, subject to the legal rights of the consumer.
In case of a non-conforming, defective or faulty product, the customer must contact AZ FLAG as soon as possible, attaching any useful evidence: order number, description of the problem, photographs, and, where applicable, information about the parcel.
AZ FLAG will examine the request and propose, depending on the case, a replacement, a repair, a refund, or any other solution in accordance with the applicable legal warranties.
The consumer customer benefits from the legal conformity warranty provided by the French Consumer Code.
AZ FLAG is required to deliver goods in conformity with the contract and is liable for conformity defects existing at the time of delivery, under the conditions provided by applicable regulations.
The consumer has a period of two (2) years from delivery of the goods to invoke the legal conformity warranty.
In the event of a conformity defect, the consumer may request that the goods be brought into conformity by repair or replacement, free of charge, under the conditions provided by the Consumer Code.
When repair or replacement is impossible, disproportionate, or is not carried out under the conditions and within the timeframes provided by law, the consumer may request a price reduction or termination of the contract, under the applicable legal conditions.
The legal conformity warranty applies independently of any commercial warranty that may be granted.
The customer also benefits from the legal warranty against hidden defects provided in Articles 1641 et seq. of the French Civil Code, when the defect renders the product unfit for the use for which it is intended or so reduces this use that the customer would not have purchased it, or would have given a lower price for it, had they known.
In this case, the customer can request the cancellation of the sale or a price reduction, under the conditions provided by law.
When certain products benefit from a specific commercial warranty, this is indicated on the product page or in the documents accompanying the product.
The commercial warranty does not deprive the consumer of the benefit of the legal warranties.
AZ FLAG is responsible for the proper performance of obligations arising from the contract concluded at a distance, except in case of fault by the customer, unforeseeable and insurmountable act of a third party to the contract, or force majeure.
AZ FLAG cannot be held liable for damages resulting from improper use of the product, lack of maintenance, inappropriate storage, abnormal exposure or use not in accordance with its intended purpose.
For business customers, AZ FLAG's liability is limited to direct and foreseeable damages, excluding loss of operations, loss of turnover, loss of margin, loss of clientele, loss of image or other indirect damages.
AZ FLAG cannot be held liable for any delay or non-performance resulting from a force majeure event within the meaning of French law.
The following may notably constitute force majeure events, depending on the circumstances: natural disasters, fires, strikes, social conflicts, shortages, administrative restrictions, war, pandemics, network interruptions, failure of carriers or suppliers, or any external, unforeseeable and irresistible event preventing the normal performance of the contract.
For deliveries outside the European Union or to certain specific territories, customs duties, import taxes, administrative fees or other charges may be required by the authorities or carriers of the destination country.
These charges are at the customer's expense, unless expressly stated otherwise at the time of the order.
The customer is responsible for the formalities and obligations applicable to the import of products into the country of delivery.
AZ FLAG cannot be held liable for delays, blockages, fees or refusals of delivery related to customs formalities or local regulations of the destination country.
All elements of the site az-flag.com, in particular texts, photographs, images, graphics, logos, trademarks, databases, product pages, videos, icons, codes and visual elements, are protected by intellectual property rights.
Any unauthorised reproduction, representation, adaptation, extraction, distribution or exploitation of all or part of the site is prohibited.
The customer warrants holding all necessary rights on the files, logos, images, texts, designs, models, trademarks or any other element transmitted to AZ FLAG for the production of a personalised product.
The customer warrants AZ FLAG against any claim, action, demand or condemnation from a third party related to elements provided by the customer.
AZ FLAG reserves the right to refuse any order containing manifestly illegal, infringing, defamatory, hateful, discriminatory, violent, pornographic content or content infringing the rights of third parties.
Personal data collected as part of orders is processed in accordance with the privacy policy available on the site.
The customer has rights over their personal data, including rights of access, rectification, erasure, opposition, restriction, portability and withdrawal of consent when the processing is based on consent.

The customer is invited to indicate their order number and any useful information allowing the processing of their request.
In accordance with the French Consumer Code, the consumer may use a consumer mediator free of charge for the amicable resolution of any dispute with AZ FLAG, after having previously addressed a written complaint to AZ FLAG.
Following a change of mediator, the contact details of the competent mediator will be communicated on this page as soon as the designation procedure is finalised.
In the meantime, the consumer may contact AZ FLAG to obtain up-to-date information regarding the applicable mediation arrangements.
These T&Cs are governed by French law.
For consumers residing in another European Union country, the choice of French law does not deprive them of the protection of mandatory provisions of their country of residence when these are applicable.
In case of dispute with a consumer, the legal rules of territorial jurisdiction apply.
In case of dispute with a business customer, and unless otherwise mandatorily provided, the competent courts will be those of the registered office of AZ FLAG.
AZ FLAG reserves the right to modify these T&Cs at any time.
The applicable T&Cs are those in force at the time of the order.
